Terms of Service

1. Acceptance of Terms
By accessing or using Modulat ("the Service"), operated by Familia d.o.o. ("Modulat", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including account owners and members of a team.
2. Description of Service
Modulat is a link-sharing and client-portal platform built for design teams. The Service lets you create branded short links and publish client portals — branded pages, hosted at a subdomain, that can present links, notes, embedded videos, images, and downloadable files. Modulat is available as a Figma plugin and as a web dashboard at app.modulat.co. Links and portals are served from modulat.co, its subdomains, and the linkto.design domain.
3. Account Registration
To use Modulat, you must create an account through our OAuth-based authentication system. You agree to:
- Provide accurate information during registration
- Be at least 18 years of age
- Maintain the security of your account credentials
- Accept responsibility for all activity under your account
You may not create an account on behalf of another person without their explicit consent.
4. Acceptable Use
You agree not to use the Service — including any link, portal, or uploaded file — to create, host, distribute, or link to:
- Spam, malware, viruses, or any other malicious or executable code
- Phishing pages or content intended to deceive or defraud
- Illegal content, including any content that sexually exploits or endangers minors
- Content that infringes the intellectual property or privacy rights of others
- Material that harasses, abuses, defames, or threatens any person
- Content that circumvents security measures or interferes with the operation of the Service
- Links or files generated in bulk for purposes unrelated to legitimate design work
We reserve the right to suspend or terminate accounts that violate these terms, and to remove or disable any offending link, portal, or file, without prior notice.
5. User Content and Uploads
Client portals let you upload and host content such as files and images ("User Content"). You are solely responsible for the User Content you upload, publish, or share, and you represent that you have all rights necessary to do so.
You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to store, host, reproduce, and display it solely to the extent necessary to operate and provide the Service — for example, to serve your portal to the people you share it with. This license ends when you delete the content or your account, except for residual copies that may remain in backups for a limited period.
Uploads are subject to accepted file-type restrictions, a per-file size limit (currently 25 MB), and per-plan storage allotments, all of which we may change. Files are served for download rather than executed by the Service. We may remove, disable, or decline to host any User Content that violates these terms or that we reasonably believe is unlawful or harmful, and we may suspend the responsible account.
6. Intellectual Property
You retain all ownership rights to the content you create, upload, or share through the Service, including destination URLs, User Content, and associated metadata. Modulat retains all rights to the platform itself, including its design, code, branding, and infrastructure. You may not copy, modify, or reverse-engineer any part of the Service.
7. Payment and Billing
Modulat offers a free plan and paid plans, billed monthly or annually through Polar, our payment processor. By subscribing to a paid plan, you agree to:
- Provide valid payment information
- Authorize recurring charges on your chosen billing cycle until you cancel
- Cancel your subscription at any time through the dashboard
If your subscription lapses or is suspended due to failed payment, the links, portals, and hosted content associated with that account may be deactivated until the account is brought current. We do not offer refunds for partial billing periods.
8. Content Responsibility and Takedown
You are solely responsible for the content of the destination URLs you shorten and the User Content you host through Modulat. We do not routinely monitor or endorse this content. If we receive reports of abuse, infringement, or harmful content, we may disable the affected links, portals, or files and take action against the associated account.
If you believe content hosted on or linked through the Service infringes your rights or violates these terms, report it to [email protected] with enough detail for us to locate it. You can also report a link or portal directly from the "Report" link in its footer. We review reports by hand and respond as appropriate; nothing is disabled automatically.
9. Termination
Either party may terminate this agreement at any time. You may delete your account through the dashboard or by contacting support. We may terminate or suspend your account if you violate these terms or if we discontinue the Service.
Upon account deletion, your short links will stop resolving, your portals will stop being served, and associated User Content will be removed. This action is permanent and cannot be undone.
10. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Modulat shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or business opportunities, or for User Content hosted or shared through the Service.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve months preceding the claim.
11. Governing Law
These Terms are governed by the laws of Slovenia, without regard to its conflict-of-law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Slovenia.
12. Changes to Terms
We may update these Terms of Service from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.
